Consultation and strategic marketing support

All services are delivered remotely unless otherwise agreed in writing.

3. Payments & Billing

3.1 Monthly Subscription Fees

Services are provided on a monthly subscription basis unless otherwise specified. Payment is due prior to the start of each billing cycle.

3.2 Payment Methods

Payments are processed through secure third-party providers such as Stripe or PayPal.
We do not store full credit card details.

3.3 Ad Spend

Advertising spend is not included in service fees. Clients pay Google, Meta, and other platforms directly.

3.4 No Refunds

All payments are final. Due to the nature of digital marketing and service time invested, we do not offer refunds.

4. Term & Cancellation

4.1 Month-to-Month Agreement

All services are month-to-month unless otherwise agreed. There are no long-term contracts.

4.2 Cancellation

You may cancel services at any time by submitting written notice via email to [email protected].
Cancellations take effect at the end of the current billing cycle.
No prorated refunds are provided.

4.3 Company Right to Terminate

We may suspend or terminate services at any time for nonpayment, inappropriate conduct, misuse of systems, or violation of these Terms.

5. Client Responsibilities

To deliver effective services, clients agree to:

Provide necessary access to platforms (Google, Meta, GoHighLevel, etc.)

Supply accurate business information, offers, and creative assets

Maintain ownership of advertising accounts

Review and approve ads where required

Comply with all advertising platform policies

Failure to provide required access or information may delay results or limit service effectiveness.

6. Results & Performance Disclaimer

Digital marketing performance can vary based on industry, audience, competition, budget, and other factors outside our control.
Accordingly:

We do not guarantee a specific number of leads, sales, or results

We do not guarantee platform approvals (e.g., Google Ads, Meta Ads)

We do not guarantee revenue or business outcomes

We make every effort to optimize performance, but results cannot be guaranteed.

7. Intellectual Property

7.1 Company Materials

All systems, workflows, templates, funnels, automations, and intellectual property created by Scott-C Digital LLC remain our property until full payment is received.
Unauthorized sharing or reselling of our work is prohibited.

7.2 Client Materials

Clients retain full ownership of their:

Brand assets

Ad accounts

Business data

Customer lists

Websites or funnels previously owned

Any materials provided to us remain the property of the client.

8. Confidentiality

Both parties agree to maintain confidentiality regarding business information, marketing strategies, login credentials, and other sensitive data shared during the course of the engagement.

We will not disclose your information except:

When required by law

To service providers assisting in our operations (under confidentiality)

With your written consent

9. Third-Party Services

Our work may involve the use of third-party platforms such as:

GoHighLevel

Google Ads / Google Analytics

Meta Ads Manager

Stripe / PayPal

Zapier

Twilio / Mailgun

We are not responsible for outages, errors, account suspensions, or policy violations caused by these platforms.

Clients are solely responsible for maintaining compliance with advertising platform rules.

10. Limitation of Liability

To the fullest extent permitted by law:

Scott-C Digital LLC is not liable for indirect, incidental, or consequential damages

Total liability shall not exceed the amount paid by the client during the previous 30 days of service

You agree that the Company is not responsible for:

Loss of revenue

Business interruptions

Platform bans or suspensions

Data loss or third-party errors

11. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles.

Any disputes shall be resolved in state or federal courts located in Florida.
